EN TORNO AL MÉTODO DIDÁCTICO DE LAS QUAESTIONES DISPUTATAE EN LOS GLOSADORES: A PROPÓSITO DE LA QUAESTIO PROHIBENTE DEBITORE EN PILLIUS MEDICINENSIS

Previous considerations on the didactic method of the quaestiones disputatae used by the medieval glossators and aimed at introducing the students of that time in the legal practice, the present research deals with a case analysed by the glossator Pillius Medicinensis and inherent to the quaestio on the admission of the law of restitution in favour of the solvens who paid another’s debt against the prohibition of the principal debtor. In this way, based on the legal sources of the Corpus iuris civilis taken from the argumentae in favour and against the law of restitution, the methodological development of the quaestiones will be known, to finally investigate the reasons that are based on the arguments raised in the scope of the legal syllogism analysed.
